Building Permit Information

Spring Garden Township has adopted the Uniform Construction Code which uses the 2006 International Building Code for construction requirements. Building permits are required in Spring Garden Township for most construction/repair projects excluding cosmetic-type work such as painting, carpeting, replacement doors and windows.

 

Residential building permit fees are determined as follows:

 

$7.00/$1,000.00 of construction cost

$0.08 per square foot of new impervious surface coverage (if applicable)

 

Effective Tuesday, April 10, 2007, Commonwealth Code Inspection Service, Inc.will expand inspection services performed for Spring Garden Township to include residential inspections. Commonwealth has been responsible and will continue to handle commercial and industrial inspection services for the Township. Scheduling of all inspections should be made a minimum of twenty-four (24) hours in advance and requests for inspections should be made directly to the York Office of Commonwealth Code Inspection Service Inc.

Residential Inspection Prices

Residential inspection prices are for dwellings 0 to 2500 square feet. Dwellings over 2500

square feet will be charged an additional ten dollars per 100 square feet, which will be added to the total basic inspection fee. Fees are for a maximum of one inspection per category; additional inspections shall be billed at the minimum rate.

Additional inspection fees may be assessed at not less than $40.00 per visit as required

due to the complexity, number of visits, or execution of the work being done. Small-scale

projects will be priced depending on the complexity of the project, the length of the project, and the number of inspections required. Inspection fees may be assessed at not less than $30.00 per visit as required. Some examples are:

Residential Plan reviews

Residential R-3 & R-4 plan review fees are calculated as follows:

General residential (R-3 & R-4) housing and additions - $30. per hour (1 hour minimum)

Small alterations (residential decks, fences, porches, sheds etc...) - $30. per hour (1/2 hour minimum)

Permit applications are available on the Township Website by clicking on building permit application, or at the Township office from 8:00 a.m. to 4:30 p.m., Monday through Friday. Seven to ten (7-10) business days should be allowed for residential building permit approval. Commercial, industrial and institutional permit approval may take longer, depending on the scope of the project.

Requirements for Working from Your Home
If you are currently involved in a home occupation in Spring Garden Township and are not paying Business/Mercantile Tax and/or have not received approval through the Zoning Board, please call the Zoning Officer, Lynn Rinehart, immediately at 848-2858. Some types of home occupations include dealerships for Avon, Fuller Brush, Rubbermaid, Tupperware, Home Interiors, Jewelry, Pampered Chef, Princess House, health care or diet products, typing and computer services, babysitting and others. Operating a business without approval is a violation of the Zoning Ordinance and could result in legal action and/or fines.


Structures Prohibited In Street Right-of-Ways
Over the past years, problems have increased regarding "structures" being constructed within street right-of-ways.

The street right-of-way was es­tablished at the time your neighborhood was developed. Adequate space behind the street edge (curb line) was designed to be used for street improvements, such as sidewalks, curbs, utility lines, etc. Typically, a street right-of-way on a Township owned and maintained street is usually 25' from the center of the street (50' total) or 30' from the centerline (60' total).

According to the Spring Garden Township Building Permit Ordinance, no permit shall be issued for the building or alteration of any building or structure within the right-of-way limits of any street or highway, curbing or pavement. The definition of structure is "any man-made object having an ascertainable stationary location on or in land or water, whether or not affixed to the land." This includes retaining walls, fences, driveway piers and mailbox post structures larger than 6" in diameter. All these types of structures could pose a hazardous condition to vehicular traffic when situated within the right-of-way. The Township has also imposed further restrictions on mailbox posts and other structures, prohibiting certain sizes of posts to be placed at the curb.

No permit shall be issued for the building or alteration of any building or structure unless such building or alteration conforms to the required building setback lines as specified in the Spring Garden Township Zoning Ordinance. This affects fences in the front yard which are limited to 3' in height. Note also that corner lots by definition have 2 front yards (along both streets).

SOLICITATION PERMITS
If you plan to distribute flyers or solicit business or contributions by going door-to-door, you MUST FIRST register with the Spring Garden Township Administration Office. Solicitation permits cost $5.00, at which time you will be given a list of residents throughout the Township who do not wish to be contacted.
